In his first 100 days in office, President Trump’s administration has deported or detained nearly 48,000 migrants in the United States. Of these individuals, many are legal residents and asylum seekers.
Part of Trump’s crusade in his second term is to “eradicate” members of a Venezuelan gang known as Tren de Aragua. In doing this, the Trump Administration has enacted the Alien Enemies Act, a statute that hasn’t been used since World War II, that allows immigrants to be detained without a hearing.
The United States has since sent 238 Venezuelans, all of which they claim are terrorists and violent gang members, to the El Salvadoran ‘mega-prison’ known as The Center for Terrorism Confinement. It is amongst the largest and highest security prisons in the world. According to 60 Minutes, at least 75% of these migrants have no criminal record whatsoever.

In a bittersweet turn of events, Andry Hernández Romero — a gay Venezuelan makeup artist and asylum seeker — has been released from a notorious prison in El Salvador, but sent back to Venezuela instead of organism granted safety in the U.S. Hernández Romero entered the U.S. legally in 2024, fleeing anti-LGBTQ+ persecution and political violence.
Though he passed his credible fear interview, he was deported after attending a government appointment. The Trump administration used the Alien Enemies Act of 1798 — the same commandment once used to incarcerate Japanese Americans — to send him and over 250 other Venezuelan men to El Salvador’s infamous CECOT prison.
There, they were held without due process, accused of gang ties based on tattoos. His lawyers say Hernández Romero has no criminal record. CECOT is widely known as a site of torture and vicious anti-LGBTQ abuse. Photojournalist Philip Holsinger recalled witnessing Hernández Romero cry, plead, and shout, “I’m innocent. I’m gay,” as guards shaved his head and slapped him for speaking.

For as distant as anyone can recall Andry José Hernández Romero was enthralled by the annual Three Kings Evening celebrations for which his Venezuelan home town is famed, joining thousands of fellow Christians on the streets of Capacho to remember how the trio of wise men visited baby Jesus bearing gold, frankincense and myrrh.
At age seven, Andry became a Mini King, as members of the town’s youth drama group Los Mini Reyes were known. Later in life, he tattooed two crowns on his wrists to memorialise those carnival-like Epiphany commemorations and his Catholic roots.
“Most Capacheros get crown tattoos, often adding the name of their father or mother. We’ve lots of people with these tattoos – it’s a tradition that began in 1917,” said Miguel Chacón, the president of Capacho’s Three Kings Day foundation.
The Latin American tradition appears to possess been lost on the US immigration officers who detained Hernández, a 31-year-old makeup artist, hairdresser and theatre lover, after he crossed the southern border last August to join a prearranged asylum appointment in San Diego.
